Rajya Sabha chairman Venkaiah Naidu today rejected the Congress-led opposition parties' impeachment bid aimed at the removal of The chief justice of India (CJI), Dipak Misra as he felt that it lacked any substantial merit.
"Having considered the material contained in the notice of motion and reflected upon the inputs received in my interaction with legal luminaries and constitutional experts, I am of the firm opinion that the notice of the motion does not deserve to be admitted. Accordingly I refuse to admit notice of motion," said Naidu.
He went on to say:
"I have applied my mind to all five charges made out in impeachment motion and examined all annexed documents. All facts as stated in motion don't make out a case which can lead any reasonable mind to conclude that CJI on these facts can be ever held guilty of misbehavior,".
"After having perused annexures to the Motion & having detailed consultations & having studied opinions of constitutional experts I am satisfied that admission of this notice of Impeachment Motion is neither desirable nor proper".
Senior Lawyer and former Congress Rajya Sabha MP RS Sodhi supported the decision:
You know you don't have any ground, you know you can't impeach him. In spite of knowing all that still you go on & plunge in this ill-advised move. Senior Congress Leader Kapil Sibal though said that Congress would file a petition in The Supreme Court against to try and impeach the CJI again and he said that he would not want the CJI to take any decision with respect to it, be it the listing or anything else.
